Please note that this tour's availability or its itinerary is subject to change due to demand lower than min. booking requirement and adverse weather conditions. Rafting, canyoning and seakayaking may not be available at early spring and late autumn due to high water level and cold water; in such a case, Kaunos Tours will change the itinerary or offer another tour.

GENERAL TERMS & CONDITIONS

BOOKINGS, PAYMENTS & CANCELLATIONS

Your Contract:

These booking terms and conditions govern all bookings that you make with Kaunos Tours (and its villa management company Kaunos Villas), based in Dalyan, Ortaca, Turkey, an A-class travel agency officially registered by TÜRSAB (Association of Turkish Travel Agencies) since 1993 with reg. num. A-3830. Terms and conditions aply to all bookings including tours, accommodations, rent a car and transfers; they also vary depending on whether you make a booking with us for a package holiday or flight only, accommodation only or other separate travel arrangements ("Individual Components"). If you book Individual Components with us, we will make the booking as agent for the relevant supplier(s) (e.g. the airline or hotel supplier) and your contract will be subject to the supplier's own terms and conditions which could limit or exclude liability to you, often in accordance with international conventions. Copies of the supplier's terms and the international conventions are available on request. If you book a package holiday, your contract will be with Kaunos Tours. Please see the terms which apply to package holiday contracts which follow these website agency terms and conditions.

No contract will come into existence until we accept your booking and we receive your full payment in cleared funds. We reserve the right to refuse, at our sole discretion, any booking. For online bookings, the contract will come into existence upon acceptance of the booking conditions presented at the end of the booking process and once we have received your full payment in cleared funds.

All services offered are subject to availability.

When you make a booking, you confirm that you have the authority to accept, and do accept these conditions on your behalf and on behalf of all members of your party and further, if you are making a booking for more than one person, that you are responsible for all payments due from each and every party member for whom you are making a booking.

It is your responsibility to ensure that any information which you give us is accurate and that information which is given to you by us or any of our suppliers is passed on to all members of your party.

Bookings made online:

If you book online, you must provide us with all information which we require. You must also ensure that the credit card you are using is your own (or, subject to our agreement, if it is a third party's you have their express authorisation, to use their credit or debit card) and that sufficient funds are available to cover the cost of the arrangements which you book with us.

When we receive and accept your booking we will send you a confirmation e-mail and invoice and debit payment from you. We do not make any representation or warranty as to the availability of any package holiday, flight or Individual Components nor that our booking services are free from infection of viruses or anything else that has a contaminating or destructive effect on your property.

Bookings made by telephone:

If you make a booking by telephone you must provide us with all information which we require. You must also ensure that all information which you provide is accurate and that the credit card you are using is your own or, subject to our agreement, if it is a third party's you have their express authorisation to use their credit or debit card and that sufficient funds are available to cover the cost of the arrangements which you book with us.

If we accept your booking, we shall debit payment from you and send you a confirmation invoice. From this point on, cancellation charges will apply. Please note that a telephone booking confirmation is as firmly confirmed as if it were made/confirmed in writing immediately. As soon as you receive the confirmation, please check the details carefully and inform us immediately if anything appears to be incorrect as it may not be possible to make changes later.

Payments:

All fees include the Turkish VAT. Kaunos Tours accepts payments by credit card (Visa or Mastercard) or cash, both in Turkish Lira, GBP, Euro or US Dollars. On-line payments are possible by credit card only. If you do not wish to use your card for any reason, please contact us by e-mail for our bank details for wire transfer payments.

Credit card payments may be subject to a surcharge by banks; you will be informed about any surcharges and it is your responsibility to cover such fees. Please note we do not accept responsibility for cash sent by courier or post, even if sent by registered or recorded delivery post or any other special delivery.

All bookings require full payment at time of booking for confirmation. Reservations made without full payment will be treated as conditionally confirmed, pending full payment, which must be done 60 days prior to tour/service start date; you must pay the balance by the due date shown on the confirmation invoice. If the booking is made within 60 days of departure, full payment must be made at the time of booking. On conditions where this is not possible for you for any reason, please contact us by e-mail for conditional reservations. 

Please note for telephone bookings full payment may be required IMMEDIATELY, i.e. before you receive our confirmation invoice. If this applies, you will be advised when the booking is made.

It is very important that you pay balances when due, as failure to do so may lead to the cancellation of your holiday/flights and still leave you liable to pay cancellation charges. Where an extra booking charge applies, this will be advised at the time of booking. 

We reserve the right to increase or decrease brochure prices and to change any information in our brochures or on our website before a booking is made.You will be informed about the correct up to date price before you book. Until full payment has been received, the price of your booking may increase as a result of fuel or other surcharges which may be imposed by suppliers; you will be informed about any increase as soon as we know them.

Cancellations:

Cancellations are possible with e-mail (to bookings@kaunostours.com ) or fax (to +90 (0) 252 284 4157) notices according to the following scheme:

Package Tours, Accommodations, Rent a car: 100% refund, if cancellation is done 90 days or more before tour/service start date; 70% refund, if cancellation is done within 89-60 days before tour/service start date; 30% refund, if cancellation is done within 59-30 days before tour/service start date; no refund, if cancellation is done less than 30 days before tour/service start date.

Daily Tours, Transfers: 100% refund, if cancellation is done 22 days or more before tour/service start date; 70% refund, if cancellation is done within 21-16 days before tour/service start date; 30% refund, if cancellation is done within 15-8 days before tour/service start date; no refund, if cancellation is done less than 8 days before tour/service start date.

Behaviour:

You accept responsibility to ensure that you & the members of your party do not behave in a way which causes offence to others or risks any loss or damage to property, vehicle or any asset belonging to Kaunos Tours or others. Payments for any such damage or loss must be made at the time direct to the accommodation, restaurant, vehicle or other facility or asset owner or manager or other supplier. You indemnify us against any claims (including legal costs) subsequently made against us as a result of your actions. We expect all clients to have consideration for other people. If in our reasonable opinion or in the opinion of any other persons in authority you are behaving in such a way to cause or to be likely to cause distress, danger or annoyance to any third party or damage to property, we reserve the right to terminate your arrangements without notice. In this situation your total booking with us will immediately cease and we will not be responsible for paying any costs, expenses, refunds or compensation.

Force Majeure:

We will not pay you compensation and will not be held responsible, if we have to cancel or change your bookings in any way because of unusual or unforeseeable circumstances beyond our control. These can include war or threat of war, civil strife, industrial dispute including air traffic control disputes, terrorist activity and its consequences, natural and nuclear disaster, fire or adverse weather conditions, epidemics & pandemics, unavoidable technical problems with transport, closure or congestion of airports or ports.

INSURANCE, SPECIAL REQUESTS AND MEDICAL CONDITION

If you have any special requests, please advise us at time of booking. Although we will endeavour to accomplish or pass any such requests on to the relevant supplier, we regret that we cannot guarantee any request will be met. Failure to meet any special request will not be a breach of contract on our part.

If you have any medical problem or disability which may affect your arrangements, you must advise us in writing before of booking giving full details. If we feel unable to properly accommodate your particular needs, we reserve the right to decline/cancel your booking.

Insurance:

Kaunos Tours provide a special outdoor tour insurance to cover its clients during outdoor activities. Nevertheless, we strongly recommend that you and all members of your party are covered by a policy of travel and activity insurance.

Medical conditions & safety briefing for Outdoor Tours:

As you may be doing some activities at outdoors such as jeep safari, seakayaking, canyoning, trekking, mountainbiking, rafting and paragliding, Kaunos Tours requires that all participants of such excursions are given a safety briefing in order to ensure safety and comfort at all times. We will be asking your signature to confirm that you have read, understood and agreed with the information given below:

ACCOMMODATION RESERVATIONS

Reservations for accommodation are accepted by Kaunos Tours and/or Kaunos Villas on behalf of the property owners, on the following conditions:-

The hire of the property is between the hirer (guest) and the property owner.  Kaunos Villas act only as agents.

The booking is deemed to have been made once the guest has completed the booking form, paid the deposit and Kaunos Villas have despatched a confirmation of booking.

For bookings made more than 60 days before arrival, a deposit of 30% of the property price is required.  The balance is due 60 days before the holiday commences, without further demand.  If the balance payment is not received by the date due on the Booking Confirmation Form, we, at our discretion, reserve the right to make the property available for re-booking.  This does not release the guest from their obligation.  It is possible to secure bookings by telephone using a Credit Card.

Properties are available for occupation from 4pm (occasionally later) on the first day of the holiday and must be vacated by 10am on the last day.  In some circumstances it may be possible to stay on at the property until closer to flight time.  However this has to be arranged with us and is at our discretion if no other party is due to arrive.

The guest and party must use the property responsibly and comply with any reasonable rules laid down by the owner.  If the owner does not communicate any such rules to you, you must assume that normal rules (such as consideration for neighbours) apply.

No more than the maximum number of persons stated on the website and included on the booking form may occupy a property unless by prior written agreement with Kaunos Tours or Kaunos Villas.  Extra charges may be applicable.

The guest must keep the property clean and in good order and will be responsible for any damages or breakages.  During the period of tenancy the guest is responsible for the care of the property and its contents.  It is expected that guests treat the property with the respect that they treat their own and leave the property and its fixtures and fittings in a clean and tidy condition, including disposal of rubbish.  We reserve the right on behalf of the owner to collect a breakages deposit of £300.  This deposit will be refunded to the guest once the property has been checked on departure, but a deduction will be made for any breakages or damages done to the property or if it is not left in a clean and tidy condition, including rubbish/waste disposal.  The sum of £50 will be deducted for cleaning if this is the case.

Once a booking has been accepted by Kaunos Tours or Kaunos Villas it can only be changed to either another property or different dates by treating the original booking as a cancellation.  Holiday dates may be changed providing the property is available for the new dates and the owner is agreeable to the change.  A £20 Administration Fee will be payable.

We have inspected the standard of facilities in all properties but cannot accept responsibility for any changes made by the owner since the inspection, or failure by the owner to keep the property dry, clean and in good repair.

Kaunos Tours and Kaunos Villas acts as booking agent only and cannot be held responsible for any accidents or injury to the guest or any member of the guests party or for any loss or damage to their properties. Wes recommend that guests purchase comprehensive travel insurance before departure.  We reserve the right to dispose of any guests personal belongings, after the departure day of the guests from the property without further reference to the guests.

We reserve the right to refuse any booking and to cancel on behalf of the owner any booking already made if the property is unavailable (ie. Through fire, flood etc) for any reason whatsoever subject to a full refund of all monies paid less a £20 Administration Fee.  In the unlikely event of a cancellation, we will make every possible effort to secure alternative accommodation if required.

Cancellation takes effect only when notification is received by Kaunos Tours or Kaunos Villas from the person who has made the rental agreement.  Cancellation notification applies from the date we receive the notification.  For cancellation until 90 days prior to the arrival date there is no penalty; from 89 days to 60 days a penalty of 30% applies; from 59 days to 30 days a penalty of 70% applies; and from 29 days to 0 days a penalty of 100% applies to total amount. We strongly recommend that clients take out appropriate travel insurance in order to be covered for cancellation.

We cannot accept liability or responsibility for any alterations, delay or cancellation or any other loss or damage caused by war, civil strife, terrorist action, industrial disputes, fire, sickness, bad weather, epidemics, acts of any government, or public authority, changes imposed by re-scheduling of airlines or any event outside our control.

Cot and/or high chairs may be available in some properties.  If the property does not offer these, Kaunos Villas may be able to hire them out at £5.00 per item per day.  No cot bedding is available.  A single folding bed is also available for hire at £5.00 per day. Bed linen, towels and tea towels may or may not be provided.  Beach towels are not provided. Please check individual property descriptions carefully.

Please let us know immediately if there are any specific needs you may have including disability needs.  We will endeavour to advise and assist in any way.  Some properties/locations to not lend themselves to easy access and facilities, so please ask first to avoid disappointment.  We have a wheelchair that can be hired out for £5.00 per day which is used at the guests own risk.

The swimming pools are normally open from April to October.  At all times, you and your group must use the pool in a correct manner, according to the rules of the owner, and taking normal safety precautions.  Children are not allowed to use the pool unsupervised.  The property owner and we cannot accept responsibility for your safety.

Complaints must be made immediately by telephone or in person to Kaunos Tours or Kaunos Villas. Complaints made after the end of your rental period cannot be taken into consideration.

The property must be vacated by 10.00am on the day of your departure.  Arrangements may possibly by made for you to stay on at the villa but purely at our discretion. To allow for cleaning, entrance may not be gained before 4.00pm unless prior arrangements have been made with us.

TRAVEL ARRANGEMENTS

Health:

Recommended inoculations for travel may change at any time and you should consult your doctor on current recommendations before you depart. It is your responsibility to ensure that you obtain the recommended inoculations, take all recommended medication and follow all medical advice in relation to your trip.

Passport and Visa:

You must consult the relevant Embassy or Consulate for this information. Requirements may change and you should check for up-to-date position in good time before booking/departure. You must have a passport which is valid for six months after your intended date of return. You must ensure you have correct visa and health entry requirements for all countries visited including countries you may just be transiting through. This includes all stops made by the aircraft even if you do not leave the aircraft or airport. We accept no liability if you are refused entry onto the flight or into Turkey due to failure on your part to carry the correct passport, visa or other documents required by any airline or authority.

Arrival and departure details:

It is your responsibility to inform us about your arrival and departure flight details, so we can plan our services accordingly. Kaunos Tours will not be liable for any service interruption or related problems due to any delays, flight cancellations or inaccurate information you have provided.

PRIVACY POLICY

Kaunos Tours is strongly committed to protecting your privacy and will do the utmost to ensure the information you provide with us is protected.

In order to process your booking and to ensure that your travel arrangements run smoothly and meet your requirements, we need to use the information you provide such as name and address, and any special needs/dietary requirements, etc.  Such information will not be shared with third parties, other than any relevant suppliers of your travel arrangements such as airlines, hotels, transport companies, etc., and security or credit checking companies, public authorities such as customs and immigration if required by them, or as required by law. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary or religious requirements. If we cannot pass this information to the relevant suppliers, whether in the EEA or not, we cannot provide your booking. In making this booking, you consent to this information being passed on to the relevant persons.

Information we collect:

Kaunos Tours requests on this website only the required information to perform your booking and fulfill your requirements. Such information includes personal information (full name, address, telephone, e-mail, preferences such as dietary or religious requirements, medical condition), tour or related information (group size, accommodation name, dates of tour/transfer/check-in, rental type) and, if booking on line, payment information (name on credit card, credit card number, expiry date, security code).

How the information is used:

Kaunos Tours uses the information you provide us in order to secure and confirm your booking or reservation, monitor your reservation status, get payment for your bookings, plan, create and perform itineraries as per your bookings, and respond to any enquiries you may have. 

Kaunos Tours uses "cookies" to collect and store information. A "cookie" is a file that contains data that a website server stores on your computer's hard drive. Your information is stored in the cookie, and we can recognize you when you return to our Web site. The use of cookies helps us move you through the reservations process faster. Jurisdiction:

This contract is governed by the Turkish Law, and any dispute arising between the parties is subject to the jurisdiction of the courts of Turkey.
